1. About these terms

These terms apply to all services I provide. In them, I, me and my mean Play Practitioners Ltd, a company registered in England and Wales (number 15482602), trading as Play Practitioners. You and your mean the school or organisation that books my services.

By confirming a booking you accept these terms. If different terms apply to a particular booking, I will tell you in writing at the time, and those terms take priority over these.

2. My services

I provide:

  • Early Years quality audits, covering provision, documentation, environment and practice, reviewed against British curriculum and inspection expectations
  • Consultancy and improvement support, following an audit or as a standalone engagement
  • Professional learning for teaching teams and leaders, delivered on site or online

The scope, dates, deliverables and fees for your booking sit in a separate written proposal. That proposal forms part of our agreement.

3. Discovery call

Before you book, I offer a free twenty-minute call. We use it to work out whether I am the right fit for your school and to help you decide. It places no obligation on either of us. I do not give audit findings or advice during the call.

4. Quotation and booking

I send you a written proposal setting out scope, dates, deliverables and fees. The proposal stands for thirty days unless I say otherwise.

Your booking is confirmed when I receive your deposit. Until then I hold dates provisionally and may release them to another client.

If I become unavailable for a confirmed date, I will offer you an alternative. If no alternative works for you, I will refund everything you have paid, less any costs I cannot recover.

5. Scope and deliverables

Your proposal states what I will review and what I will produce. For an audit, that is normally a written report.

I will issue the report within 15 working days of completing the review, unless your proposal says otherwise.

The fee includes one round of factual correction. Tell me within ten working days of receiving the report if any factual detail is wrong and I will amend it.

Anything beyond factual correction is new work and I will quote for it separately. That includes reviewing additional phases, settings or documents that were not listed in the proposal.

6. Fees

Fees are quoted in US dollars and set out in your proposal. They do not include expenses, which section 7 covers.

Where participant numbers affect delivery, I quote on the numbers you give me. If more people attend than we agreed, the nature of the delivery changes and I reserve the right to apply a surcharge.

7. Expenses

For work at your site, you either arrange my travel and accommodation or reimburse me for it. Travel and accommodation must be of a standard that lets me arrive rested and do my job properly.

In addition to my fees, I may recover from you:

  • reasonable travel, accommodation, subsistence and associated costs
  • visa, entry permit and travel insurance costs where the visit requires them
  • the cost of any third party services I need in order to deliver the work
  • the cost of materials needed to deliver the work

Where I book travel myself, I book early to secure the best rate. Section 9 explains what happens to those costs if you cancel.

8. Payment

  • 50% of the fee is due to confirm your booking.
  • The remaining 50% is due 14 days before delivery begins, or before I issue the report where the work involves no visit.
  • I release reports and other deliverables once I have received payment in full.
  • I invoice expenses separately after delivery, unless we agree otherwise.
  • All payments are in US dollars unless we agree otherwise in writing. You cover any transaction or currency exchange charges, so that I receive the full invoiced amount.
  • I accept payment by transfer to a UK bank account.
  • Invoices are payable within 14 days. On overdue amounts, I may charge interest at 4% a year above the Bank of England base rate, calculated daily from the due date until payment.

9. Cancellation, postponement and amendment

If you need to change any detail of your booking, tell me in writing as soon as you can. I cannot promise I will be able to accommodate a change, but I will be as flexible as I reasonably can.

If you cancel a confirmed booking, these charges apply:

  • more than 8 weeks before the start date: an administration fee of US$200
  • 4 to 8 weeks before the start date: 50% of the quoted fee
  • less than 4 weeks before the start date: 100% of the quoted fee

On top of that, if I have booked travel or accommodation that I cannot refund or transfer, you cover those costs.

If you postpone rather than cancel, and we agree a new date within six months, I may reduce or waive the cancellation charge. That decision rests with me.

If I cancel a confirmed booking, for any reason including illness or family emergency, you pay nothing and I refund anything you have already paid.

If circumstances beyond my control mean I need to change your booking or how I deliver it, I will tell you as soon as I can and keep the changes to a minimum.

If you do not give me reasonable notice of a change and we cannot agree an alternative date, I will treat the booking as cancelled by you and the charges above apply.

10. What you provide

For work at your site:

  • a suitable venue and working space
  • refreshments
  • equipment as agreed, such as a device and projector, flip charts, pens and paper
  • access to the documents, spaces, staff and information set out in the proposal
  • a named contact who can answer questions and arrange access

For online work you provide the delivery platform. I can supply a platform at additional cost where one is available.

If you cannot give me access to the agreed people, spaces or documents, I may not be able to complete the review as scoped. I will tell you if that happens. Any resulting reduction in scope does not reduce the fee.

11. What I provide

  • delivery of the agreed audit, consultancy or professional learning
  • supporting resources and materials as set out in the proposal
  • the agreed outputs, which for an audit is normally a written report

12. Safeguarding and conduct on site

I hold an enhanced DBS check and will provide evidence on request. If you need further checks, clearances or references before I visit, tell me at the time of booking so I can arrange them. Where a check carries a cost, I may recover it as an expense.

While I am at your school, I follow your safeguarding, child protection, and health and safety policies. Please send me those policies before I arrive.

If I see or hear anything during a visit that raises a safeguarding concern, I will report it to your designated safeguarding lead. If the concern involves that person, or if I judge that the school has not acted appropriately, I may report it to the relevant external authority. I cannot agree to keep a safeguarding concern confidential, and nothing in these terms prevents me from making a report.

13. My advice and inspection outcomes

My audits and reports give you my professional opinion. That opinion rests on the evidence available to me during the review and on my experience of Early Years practice and inspection frameworks.

I am not an inspectorate. I do not act for BSO, COBIS, CIS or any other inspection or accreditation body, and I have no influence over their judgements. My review is not an inspection and my report is not a prediction of one.

I cannot guarantee any inspection outcome, accreditation decision, rating or grade. Inspection judgements rest on many factors outside my control, including how you act on my recommendations, changes to your staff and provision, changes to the framework itself, and the judgement of the inspection team on the day.

You remain responsible for the decisions you take about your provision. My report is advice for you to weigh up, not an instruction, and acting on it does not transfer responsibility for those decisions to me.

My findings reflect what I could see and access at the time of the review. I rely on the accuracy and completeness of the information you give me. Where that information is inaccurate or incomplete, my findings may be affected, and I am not responsible for the consequences.

14. Confidentiality

Each of us may see information belonging to the other that is not public. Neither of us will share it without permission, unless the law requires it or section 12 applies.

I treat your documents, data, findings and the content of my report as confidential. I will not share your report or name you as a client without your written permission.

You treat my proposals, fees, methods, tools and materials as confidential.

I may refer to my work in anonymised form, for example describing the type of school, the challenge and the outcome, without naming you. I will only name you, quote you or use your logo with your written permission, and you may withdraw that permission at any time.

This section continues to apply after our work together ends.

15. Intellectual property

I own the copyright and all other intellectual property rights in my materials, including presentations, handouts, tools, frameworks and reports, unless we agree otherwise in writing.

Once you have paid in full, I grant you a licence to use your report and the materials I supply inside your own school, for your own improvement purposes. You may not sell them, publish them, or pass them to other organisations, including other schools in your group, without my written permission.

You may not record any session, online or in person, without my written permission. Please ask at the time of booking. When you ask, tell me how many people will have access to the recording, whether you will charge for that access, and for how long it will be available. I may charge an additional fee for permission to record.

I will take appropriate action to prevent infringement of these rights.

16. Your data

I hold and process personal data in line with my Privacy Policy. In summary:

  • I hold your contact details and booking information so that I can arrange, deliver and invoice for the work.
  • During an audit I may see personal data about your staff and children, including records, observations and assessments. I use that data only for the review. I do not remove identifiable personal data from your site unless we agree it in writing, along with how it will be protected.
  • My reports refer to staff by role rather than by name, unless you ask me to do otherwise.
  • I delete or return personal data relating to your setting within six months of completing the work, apart from the report itself and the records I must keep for tax and insurance.
  • Where I work with schools outside the UK, we will agree in writing any arrangements needed to transfer personal data lawfully.

If you need me to sign a data processing agreement or your own data protection terms, please send them at the time of booking.

17. Circumstances beyond our control

Neither of us is liable for failure or delay in meeting our obligations where the cause lies beyond our reasonable control. Such causes include industrial action, civil unrest, fire, flood, storms, earthquakes, epidemics, acts of terrorism, acts of war, border closures, travel restrictions and government action.

If the delay runs for 90 days, either of us may end the agreement. I will then refund fees for work I have not delivered, less any costs I cannot recover.

18. If something goes wrong

If you are unhappy with any part of my work, tell me directly and tell me early. I will respond within five working days and do what I reasonably can to put it right. Most problems are solved by a conversation.

19. Governing law

The law of England and Wales governs these terms. The courts of England and Wales have exclusive jurisdiction over any dispute, wherever your school is based.

20. Changes to these terms

I may update these terms from time to time. The terms that apply to your booking are the ones published on the day I confirm it.
